§ 2 Contracting party, conclusion of contract

2.1 The product representations in the online shop are non-binding and serve only to submit a purchase offer by the customer. By clicking the button [Complete order with costs] the customer makes a binding offer to buy.

2.2 The binding purchase contract is concluded by our sending an order confirmation by e-mail, at the latest, however, upon delivery of the ordered goods. Our order confirmation is sent by automated e-mail immediately after the completion of your online order.

2.3 If our order confirmation should contain technically caused errors in content or form that deviate from the customer's order data, we are entitled to withdraw from the purchase contract, whereby we must prove the technically caused errors. Payments already made will be refunded immediately.

2.4 The buyer undertakes to have reached the required minimum age when placing the order, which may be indicated for articles with age restrictions.

2.5 You will receive invoices and credit notes exclusively in electronic form.

§ 3 Contract language, contract text storage

3.1 The language available for the conclusion of the contract is german.

3.2 We save the text of the contract and send you the order data and our General Terms and Conditions by e-mail. You can view the GTC at any time also here on this page. You can view your past orders in our customer login.

§ 4 Prices

The prices stated on the product pages include the statutory value added tax and other price components and do not include shipping costs.

§ 5 Shipping costs

5.1 For delivery within Germany we charge a flat rate of EUR 4.95 per order. From an order value of EUR 72.00 we deliver free of charge within Germany.

5.2 For delivery to Austria we charge a flat rate of EUR 8.00 per order. From an order value of EUR 72.00 we deliver free of charge to Austria.

5.3 If payment is made by cash on delivery, an additional C.O.D. fee of EUR 3.60 is due, as well as a fee of EUR 2.00 charged by the local delivery agent.

§ 6 Terms of delivery and reservation of self-delivery

6.1 Delivery is only within Germany and to Austria with DHL.

6.2 The delivery time within Germany is 1 to 2 days, unless otherwise stated on the order item. The delivery time to Austria is 2 to 3 days.

6.3 If not all ordered products are in stock, we are entitled to make partial deliveries at our expense, as far as this is reasonable for you.

6.4 Should the delivery of the goods fail through your fault despite three delivery attempts, we can withdraw from the contract. Any payments made will be refunded to you immediately.

6.5 If the ordered product is not available because we are not supplied with this product by our suppliers through no fault of our own, we can withdraw from the contract. In this case we will inform you immediately and, if necessary, suggest the delivery of a comparable product. If no comparable product is available or you do not wish to receive a comparable product, we will immediately refund any payments already made.

6.6 Shipping costs are added to the stated product prices. You will find more details about the amount of the shipping costs in the offers. In principle, you have the option of picking up your order at Metabolic Basics GmbH, Daimlerstrasse 12, 89312 Günzburg, Germany during the business hours stated below: Monday to Friday from 8.00 to 17.00 hours.

§ 7 Terms of payment

In our shop, the following payment methods are available to you:

7.1 cash on delivery
You pay the purchase price directly to the deliverer. There is an additional charge of 3,60 Euro. Additionally 2,00 Euro are to be paid directly to the deliverer.

7.2 Credit card
When you place an order, you simultaneously send us your credit card details. After your legitimation as a legitimate cardholder, we will ask your credit card company to initiate the payment transaction after you have received the goods. The payment transaction will be carried out automatically by the credit card company and your card will be charged.
There will be an additional charge of 0.00 percent of the purchase price.

7.3 SEPA Direct Debit
When you submit your order, you give us a SEPA direct debit mandate. We will inform you about the date of the debit (so-called prenotification). Upon submission of the SEPA Direct Debit Mandate, we request our bank to initiate the payment transaction. The payment transaction will be executed automatically and your account will be debited. The account will be debited after you have received the goods. The period for advance notice of the date of the account debit (so-called prenotification period) is reduced to 14 days.
There will be an additional charge of 0.00 percent of the purchase price.

7.4 PayPal
During the ordering process you will be redirected to the website of the online provider PayPal. In order to pay the invoice amount via PayPal, you must be registered there or register first, authenticate with your access data and confirm the payment order to us. After placing the order in the shop, we will ask PayPal to initiate the payment transaction. You will receive further instructions during the ordering process. The payment transaction will be carried out automatically by PayPal immediately afterwards.
PayPal: There is an additional charge of 0.00 percent of the purchase price.

7.5 IMMEDIATELY bank transfer
After placing the order you will be redirected to the website of the online provider IMMEDIATELY transfer. In order to pay the invoice amount via IMMEDIATE bank transfer, you must have an online banking account with PIN/TAN procedure activated for participation in IMMEDIATE bank transfer, you must identify yourself accordingly and confirm the payment order to us. You will receive further instructions during the ordering process. The payment transaction will be executed immediately afterwards by IMMEDIATELY bank transfer and your account will be debited.
There will be an additional charge of 0.00 percent of the purchase price.

7.6 Giropay
After placing the order you will be redirected to the website of your bank. In order to be able to pay the invoice amount via Giropay, you must have an online banking account with PIN/TAN procedure activated for participation in Giropay, identify yourself accordingly and confirm the payment order to us. You will receive further instructions during the ordering process. The payment transaction will be executed immediately afterwards and your account will be debited.
There will be an additional charge of 0.00 percent of the purchase price.

7.7 Purchase on account via BillSAFE
You will be forwarded to the website of the online provider BillSAFE. You do not need to be registered there to pay the invoice amount via BillSAFE. After a successful address and credit check and submission of the order, we assign our claim to BillSAFE. In this case you can only make payment to BillSAFE with debt discharging effect. For payment processing via BillSAFE, the BillSAFE General Terms and Conditions and the BillSAFE data protection declaration apply - in addition to our General Terms and Conditions. 7.8 Invoice

7.9 Cash payment on collection
You pay the invoice amount in cash upon collection.

7.10 If you are in default of payment, the purchase price will be subject to interest at a rate of 5% above the base interest rate for the duration of the default. We reserve the right to prove and claim higher damages caused by default.

§ 8 Retention of title

The goods remain our property until full payment has been received. Prior to the transfer of ownership, pledging, transfer by way of security, processing or transformation is not permitted without our consent.

§ 9 Right of withdrawal for consumers

9.1 Consumers have a right of withdrawal for a fortnight. A consumer is any natural person who enters into a legal transaction for purposes that are predominantly neither commercial nor their independent professional activity.

9.2 Return costs when exercising the right of revocation
If you make use of your legal right of revocation (see revocation instruction), you have to bear the regular costs of the return shipment, if the delivered goods correspond to the ordered goods and if the price of the goods to be returned does not exceed an amount of 40 Euros or if, in case of a higher price of the goods, you have not yet rendered the consideration or a contractually agreed partial payment at the time of the revocation. Otherwise the return shipment is free of charge for you.

§ 10 Damages in transit

10.1 If goods are delivered with obvious transport damages, please complain about such errors immediately to the deliverer and contact us as soon as possible (phone +49 8221 36 75 6 - 0).

10.2 Failure to make a complaint or contact us will not have any consequences for your statutory warranty rights. However, you help us to be able to assert our own claims against the carrier or the transport insurance.

§ 11 Warranty and guarantees

11.1 Unless expressly agreed otherwise below, the statutory liability for defects shall apply. The limitation period for claims for defects is one year from delivery of the goods in the case of used goods.

11.2 The above limitations and shortening of the period do not apply to claims based on damage caused by us, our legal representatives or vicarious agents

  • in the event of injury to life, body or health,
  • in the event of intentional or grossly negligent breach of duty or malice,
  • in the event of breach of essential contractual obligations, the fulfilment of which is essential for the proper execution of the contract and on the observance of which the contractual partner may regularly rely (cardinal obligations)
  • within the framework of a guarantee promise, if agreed or
  • as far as the scope of application of the product liability law is opened.

11.3 Information on any additional warranties that may apply and their exact terms and conditions can be found with the product and on special information pages in the Online Shop.

§ 12 Liability

12.1 For claims based on damages caused by us, our legal representatives or vicarious agents, we are always liable without limitation

  • in the event of injury to life, body or health,
  • in case of intentional or grossly negligent breach of duty,
  • in the case of guarantee promises, if agreed, or
  • as far as the scope of application of the product liability law is opened.

12.2 In the event of a breach of material contractual obligations, the fulfilment of which is essential for the proper performance of the contract and on the observance of which the contracting party may regularly rely (cardinal obligations) due to slight negligence on our part, on the part of our legal representatives or vicarious agents, liability shall be limited in amount to the damage foreseeable at the time of conclusion of the contract, the occurrence of which must typically be expected. Otherwise claims for damages are excluded.

§ 13 Online dispute resolution

13.1 The European Commission provides an online dispute resolution (OS) platform, which can be found at http://ec.europa.eu/consumers/odr/. Consumers have the possibility to use this platform for the settlement of their disputes.

§ 14 Protection of minors

14.1 If your order includes goods whose sale is subject to age restrictions, we will ensure that the customer has reached the required minimum age by using a reliable procedure involving a personal identity and age check. The deliverer only hands over the goods after the age check has been carried out and only to the orderer personally.

§ 15 Final provisions

Should any provision of these General Terms and Conditions of Business be invalid, the remainder of the contract shall remain valid. Instead of the invalid provision, the relevant statutory provisions shall apply.
